1. General

This website and URL address, www.mzansiphilharmonic.org.za is owned by the Mzansi National Philharmonic Orchestra, ticketing powered by Quicket. Quicket operates this service on behalf of the Mzansi National Philharmonic Orchestra. All terms and conditions displayed on this website are to be read together with any other policies and conditions displayed elsewhere on this website and with any terms and conditions that may be printed on the ticket or displayed at the entrance to our events.

2. Mzansi National Philharmonic Orchestra Event House Rules

The use of cameras, video, audio, or visual recording equipment during performances is strictly prohibited. Mobile phones, pagers, and digital watches must be silenced/switched off prior to the show.

The Mzansi National Philharmonic Orchestra reserves the right to:

  1. Check that every patron has a valid ticket
  2. Refuse admission of the ticket holder to the premises or request the ticket holder to leave the premises if due reason or cause is given
  3. Make alterations to the advertised event program, seating, or cast in the event of an illness or unavoidable cause, without prior notice
  4. Cancel or abandon, in extreme circumstances, any event or performance without notice. For cancellations, every effort will be made to contact customers to notify them in advance
  5. Not accept responsibility for any loss or damage to persons or property on or around our performance venues
  6. Require latecomers to wait until a suitable break in the event program before entering the auditorium

3. Website

When you make a purchase on this website, you agree to be bound by these terms and conditions and policies displayed elsewhere on this website. Quicket, with the permission of the Mzansi National Philharmonic Orchestra, may alter or change the terms and conditions from time to time, and by using this service, you agree to be bound by any such alterations or changes and use of this website.

The images, text, logos, and artwork contained in this website are copyrighted to the Mzansi National Philharmonic Orchestra and/or the license owners and used by permission; all rights reserved. Unauthorised use by way of copying, storage, reproduction, publishing electronically, or otherwise, transmitting in any form or by any means in whole or in part is prohibited. This website is provided solely for your own use, and you should not, without the Mzansi National Philharmonic Orchestra’s written permission, transfer or sell or attempt to transfer or sell access to or use of this website (or any part or facility of it) or any of your rights or obligations under these terms and conditions to any other person.

4. Event Bookings

Each event or performance may have its own entry conditions, and the Mzansi National Philharmonic Orchestra recommends that you view these prior to purchasing tickets. They are usually available on the event advertising media or elsewhere on this website.

No order placed by you is deemed to be accepted by the Mzansi National Philharmonic Orchestra or Quicket until a written acknowledgement of order is issued by Quicket and Quicket has received the payment due. You warrant that all information you give to the Mzansi National Philharmonic Orchestra and Quicket while using the website is correct. If the information changes prior to your attendance of the event or performance, it is your responsibility to notify us as soon as possible.

The Mzansi National Philharmonic Orchestra reserves the right to cancel or postpone an event or performance at any time prior to the event or performance taking place. Except as stated in Section 6, the Mzansi National Philharmonic Orchestra is not liable to give any refund or exchange for any event or performance booked by you through the website. By purchasing concert tickets with the Mzansi National Philharmonic Orchestra, you are deemed to have made an offer to book an event or performance subject to these terms and conditions.

5. Tickets

It is your responsibility to check the information contained in the acknowledgement of order and that the ticket information is accurate prior to your attendance of the event or performance. On receipt of your confirmation e-mail, please check that your tickets are for the correct event or performance, date, and time, as mistakes cannot necessarily be rectified on the day of the event or performance.

By purchasing tickets, the e-mail account you nominate may receive information from the Mzansi National Philharmonic Orchestra or the event promoter relating to the event or performance you have purchased tickets for, or other events they are producing. You may opt in or out of this mailing list at any time by following the unsubscribe directions.

It is illegal to re-sell tickets for profit or gain, and any person or company attempting to do so may be prosecuted to the full extent of the law. Any such resale will render the booking void, and the ticket holder may be refused entry into the auditorium. The Mzansi National Philharmonic Orchestra reserves the right not to sell tickets to any person, agent, or company.

6. Refunds and Exchanges

The Mzansi National Philharmonic Orchestra does not offer the option to exchange tickets or refund money. Only in exceptional circumstances, as deemed appropriate by the Mzansi National Philharmonic Orchestra, will an exchange of ticket or refund be given.

6.1. Rescheduled event or performance

The Mzansi National Philharmonic Orchestra reserves the right to alter the lineup, date, time, and/or venue. If the event or performance is rescheduled, then your ticket to the advertised event or performance will remain valid. If you cannot attend a rescheduled event or performance and you contact the Mzansi National Philharmonic Orchestra in a timely manner and provide the original ticket(s) and proof of purchase, the Mzansi National Philharmonic Orchestra will refund to you, within 30 days, the full ticket price less delivery or mail fees, if any.

6.2. Cancellation

If the event or performance is cancelled because of the occurrence of any event beyond the control of the Mzansi National Philharmonic Orchestra, then refunds shall be at the Mzansi National Philharmonic Orchestra’s sole and absolute discretion.

7. Privacy

The Mzansi National Philharmonic Orchestra shall take all reasonable steps to protect your personal information. For the purpose of this clause, “personal information” shall be defined as detailed in The Promotion of Access to Information Act 2 of 2000 (PAIA). PAIA may be downloaded from: https://popia.co.za. Information transmitted via the internet is susceptible to monitoring and interception. You therefore transmit any information that may be confidential, proprietary, or sensitive in nature entirely at your own risk and under no circumstances is Quicket or the Mzansi National Philharmonic Orchestra liable for any loss, harm, or damage that you may suffer as a result thereof.

8. Disclaimer and Limitation of Liability

This website and the information contained therein are provided “as is” and the Mzansi National Philharmonic Orchestra makes no express or implied representations or warranties with regard thereto. Without limiting the generality of the foregoing:

The Mzansi National Philharmonic Orchestra does not warrant that the website or information is error-free or meets any particular criteria of performance or quality. The Mzansi National Philharmonic Orchestra expressly disclaims all implied warranties, including without limitation, warranties of merchantability, title, fitness for a particular purpose, non-infringement, compatibility, security, and accuracy.

Whilst the Mzansi National Philharmonic Orchestra has taken reasonable measures to ensure the integrity of this website and its contents, no warranty, whether express or implied, is given that any downloads or applications available via this website are free of viruses, Trojans, bombs, time-locks, or any other data or code which has the ability to corrupt, damage, or affect the operation of your system.

You acknowledge that any order that the Mzansi National Philharmonic Orchestra accepts is to be performed and managed by a third party and that we have no control over the performance and/or quality of such an event or performance. Therefore, all such bookings will be on the terms and conditions of the relevant event holder, and we accept no liability in respect of any such event or performance.

Your use of this website or any products or services advertised on this website and the information contained therein is entirely at your risk, and you assume full responsibility and risk of loss resulting from the use thereof. The Mzansi National Philharmonic Orchestra is not liable for any damages whatsoever, including without limitation, any direct, indirect, special, incidental, consequential, or punitive damages, whether in an action arising from contract, statute, delict, or otherwise, relating to the use of this website, the products and services advertised on this website, or the information contained therein.

9. Country of Domicile

This website is governed by the laws of South Africa and the Mzansi National Philharmonic Orchestra chooses as its domicilium citandi et executandi for all purposes under these terms and conditions, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 29 Acutt Street, Durban, 4001.
